Terms of Use

1. Introduction

Welcome to ClearWallet Professional ("the Service"), an enterprise-grade Cosmos SDK wallet solution operated by ClearCoin Foundation ("we," "us," or "our"). By accessing or using the Service, you ("User," "you," or "your") agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, you must not access or use the Service.

2. Acceptance of Terms

By creating a wallet, importing a mnemonic phrase, or otherwise accessing the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy. These Terms constitute a legally binding agreement between you and ClearCoin Foundation.

3. Eligibility

You must meet the following requirements to use the Service:

• You are at least 18 years of age or the age of majority in your jurisdiction.
• You have the legal capacity to enter into binding contracts.
• You are not prohibited from using the Service under applicable laws.
• You are not located in, or a resident of, any jurisdiction where the use of cryptocurrency wallets is prohibited.

4. Service Description

ClearWallet Professional provides a non-custodial wallet interface for managing CLR (ClearCoin) and CLRTx (ClearCoin Transaction Token) on the Cosmos SDK blockchain. The Service allows you to:

• Create new wallet addresses with encrypted mnemonic storage
• Import existing wallets using mnemonic phrases
• Send and receive CLR and CLRTx tokens
• View transaction history and wallet balances
• Manage wallet security through password protection

The Service is provided "as is" and "as available" without warranties of any kind.

5. User Responsibilities

5.1 Account Security

You are solely responsible for:

• Maintaining the confidentiality of your mnemonic phrase, password, and private keys
• All activities that occur under your wallet address
• Implementing adequate security measures to protect your credentials
• Notifying us immediately of any unauthorized access or security breach

WARNING: Loss of your mnemonic phrase or password will result in permanent loss of access to your wallet and funds. We cannot recover lost credentials.

5.2 Prohibited Activities

You agree not to:

• Use the Service for any illegal purpose or in violation of any laws
• Engage in fraudulent, abusive, or malicious activities
• Attempt to gain unauthorized access to the Service or other users' wallets
• Interfere with or disrupt the integrity or performance of the Service
• Use the Service to transmit viruses, malware, or other harmful code
• Impersonate any person or entity or misrepresent your affiliation
• Use automated systems (bots, scripts) to access the Service without authorization

6. KYC/AML Compliance

The Service may require Know Your Customer (KYC) and Anti-Money Laundering (AML) verification for certain users or transactions. By using the Service, you consent to:

• Providing accurate and complete identity information when requested
• Submitting to identity verification procedures
• Allowing us to share your information with third-party verification services
• Complying with all applicable financial regulations

We reserve the right to suspend or terminate accounts that fail to comply with verification requirements.

7. Intellectual Property

All content, features, and functionality of the Service, including but not limited to text, graphics, logos, icons, images, audio clips, digital downloads, and software, are the exclusive property of ClearCoin Foundation and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

8. Disclaimers and Limitations of Liability

8.1 No Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR SECURITY.

8.2 Blockchain Risks

You acknowledge and accept the inherent risks of blockchain technology, including but not limited to:

• Irreversible transactions - sent tokens cannot be recovered
• Network delays or failures
• Software bugs or vulnerabilities
• Regulatory changes affecting cryptocurrency usage
• Price volatility of digital assets

8.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CLEARCOIN FOUNDATION SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OR INABILITY TO USE THE SERVICE.

9. Indemnification

You agree to indemnify, defend, and hold harmless ClearCoin Foundation, its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to:

• Your use or misuse of the Service
• Your violation of these Terms
• Your violation of any rights of another party
• Your violation of any applicable laws or regulations

10. Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without cause, with or without notice, for any reason including but not limited to:

• Violation of these Terms
• Suspected fraudulent or illegal activity
• Failure to complete KYC/AML verification
• Extended period of inactivity

Upon termination, your right to use the Service will immediately cease. Termination does not affect the blockchain records of your transactions or your ability to access your funds through other means if you have retained your mnemonic phrase.

11. Modifications to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by:

• Posting the updated Terms on the Service
• Updating the "Last Updated" date
• Sending notice to registered email addresses (when applicable)

Your continued use of the Service after such modifications constitutes your acceptance of the updated Terms.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which ClearCoin Foundation is registered, without regard to its conflict of law provisions. Any disputes arising out of or related to these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the applicable arbitration authority.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
